Foi Wambui Loses Bid to Exit Mutoriah Copyright Case

Foi Wambui has been ordered to remain in a copyright battle over Mutoriah’s hit song “Beta” after a court rejected her attempt to have the case against her thrown out.

The actress and content creator is facing a lawsuit filed by musician Mutoriah over the alleged unauthorised use of his song in an Oppo smartphone advertisement.

The dispute centres on a skit Wambui featured in while promoting Oppo’s Reno 12 5G. Mutoriah claims his music was used without his permission or a synchronization licence.

A synchronization licence is required when copyrighted music is paired with visual content, particularly in commercial advertising.

Mutoriah says he discovered the advert circulating on social media on August 31, 2024.

He later issued a legal notice demanding an apology and other remedies over the alleged copyright infringement.

With the court rejecting Wambui’s bid to exit the case, the copyright dispute now remains alive, putting the use of music in Kenyan influencer and brand campaigns firmly under the spotlight.
